Reclassification Council-owned land at 5 Jackson Place, Kellyville

Council is undertaking a planning proposal to amend its Local Environmental Plan, to reclassify Lot 601 DP 1083182, 5 Jackson Place, Kellyville from ‘community to ‘operational’ land within the meaning of the Local Government Act 1993.  No change to the current R2 Low Density Residential zoning is proposed. 

‘Community’ land is generally open to the public and includes places such as parks, reserves or sports grounds. ‘Operational’ land may be used for other purposes such as works depots, garages, or held by Council as an asset. 

The reclassification is being undertaken because the subject land is no longer required as a cycleway link due to the realignment of the route through Sydney Water land adjoining the future Arnold Avenue Sports Complex. The change will facilitate the sale of the land as a residential lot with the funds being allocated to assist the provision of open space and recreation opportunities in the area. 

An amendment to Council’s Development Control Plan section for Kellyville/Rouse Hill is also required to reflect the revised cycleway route, and remove an ‘open space’ notation from the site.

With respect to the land proposed to be reclassified, a public hearing is to be held as required by Section 29 of the Local Government Act 1993, at Council’s Administration Centre, 3 Columbia Court, Baulkham Hills. Notification of the public hearing will be given in the local newspaper at least 21 days prior to the public hearing being held.
