Planning Proposal, Draft Development Control Plan Amendments & Draft Voluntary Planning Agreement For Land at 21-23 Lexington Drive, Bella Vista (1/2019/PLP)


Council has resolved to publicly exhibit a planning proposal, draft Development Control Plan (DCP) amendments and a draft Voluntary Planning Agreement (VPA) with respect to land at 21-23 Lexington Drive, Bella Vista.

The planning proposal seeks to facilitate additional commercial floor space at 21-23 Lexington Drive, Bella Vista through the following amendments to The Hills Local Environmental Plan 2019:

  • Increase the maximum floor space ratio applicable to the site from 2:1 to 2.7:1; and
  • Introduce a local provision requiring concurrence of the Planning Secretary with respect to regional infrastructure.

Draft amendments to Part C Section 1 – Parking of The Hills Development Control Plan 2012 have been prepared in association with the planning proposal, to apply the Commercial Centres rate of 1 car parking space per 40m2 of commercial gross floor area.

The reduced car parking rate will allow the proposed floor space to be accommodated within the same building envelope recently approved on the site (DA 172/2022/JP), by way of converting two approved levels of aboveground car parking into additional commercial office floor space.

A draft Voluntary Planning Agreement is concurrently on exhibition, which seeks to secure a monetary contribution equating to 2.8% of the cost of development for any portion of gross floor area over the area approved in the existing DA 172/2022/JP. The monetary contribution will be allocated towards local infrastructure and public domain improvements within the vicinity of the site.

Council received a Gateway Determination for the planning proposal in December 2021. Delegation for making the Local Environmental Plan has not been issued to Council under the Gateway Determination.

The planning proposal, draft DCP, draft VPA and supporting material is now on public exhibition and available for inspection on this web page.
