Designated and Integrated Development Extractive Industry - Lot 1 DP 1223929 No.125 Smallwood Road, Glenorie



In accordance with Clauses 77 and 78 of the Environmental Planning & Assessment Regulation, 2000, notice is hereby given that Council is in receipt of Development Application No.492/2022/JP from PGH Environmental Planning on behalf of Civiltrak Sydney Pty Ltd on the above property.

The development is defined as a “Designated Development” under Schedule 3 of the Environmental Planning and Assessment Regulation, 2000.

The site is subject to an existing Development Consent for extractive industry operations under Development Application 1887/2002/HE (as amended) and a previous Development Consent for an extension of time for extraction under Development Application 96/2021/HA. The existing consent limits operation of the extractive industry until 22 October 2021.

The Development Application includes, but is not limited to, the following:

  • The continuation of the extractive industry operations for an additional six years;
  • The increase in the rate of extraction from 17,000 tonnes per annum to a maximum of 60,000 tonnes per annum;
  • An increase in vehicle movements from seven laden trucks to ten laden trucks per day; and
  • An extended period for rehabilitation of the site.

The proposal is also defined as Integrated Development under Section 4.46 of the Environmental Planning & Assessment Act, 1979 as the proposal requires a license under the Protection of the Environment Operations Act 1997 (POEO Act) from the NSW Environment Protection Authority.

The Development Application will be determined by the Sydney Central City Planning Panel in accordance with Schedule 7 of SEPP State and Regional Development 2011.

The Development Application and Environmental Impact Statement (EIS) are available for public inspection from 13 October 2021 until 15 November 2021 at the following places:

  • Online at the NSW Department of Planning, Industry and Environment’s ‘Planning Portal’; and
  • Online on Council’s website using the Application Tracking tab and DA 492/2022/JP.

Any person may make a submission in writing to Council in relation to the development application, and where a submission is made by way of an objection the grounds of that objection must be specified. Submissions are to be received no later than 15 November 2021. The planner responsible for the application is Kristine McKenzie who can be contacted on 9843 0319.

Any person who makes a submission by way of an objection and who is dissatisfied with the determination, if the Sydney Central City Planning Panel were to grant consent to the Development Application, may appeal to the Land & Environment Court in accordance with the Environmental Planning & Assessment Act, 1979. However, if an Independent Planning Commission public hearing is held, the Commission’s determination of the application is final and is not subject to Appeal.
