Draft Amendments to The Hills Section 94A Contributions Plan (FP134)

Council resolved in part at its meeting on 13 June 2017 to publicly exhibit draft amendments to The Hills Section 94A Contributions Plan. The draft amendments provide greater clarity regarding development which can be exempt from the application of the Section 94A levy.

Specifically, new exemptions would apply to any development application that proposes:

  • The repair or replacement of a dwelling or structure that was damaged or destroyed by natural forces and unpreventable events such as a fire, flood, earthquake, lightning and cyclones; or
  • “Knockdown-rebuild” or the replacement of a dwelling or structure.

In both of the above cases, the applicant would be required to demonstrate that the new development does not increase the total Gross Floor Area by greater than 20% of the existing dwelling or structure.
