Check Before You Build
Recent Planning Reforms, approved by the NSW State Government, have indicated that it will be quicker and easier to build. However, it is important to understand that generally all building work requires an approval prior to any works commencing. The planning reforms announced by the State Government are complex and it is advisable for anyone wishing to build any project to check the requirements with Council before starting any work.
Always check with Council before building to avoid the risk of a $1500 fine. It is an offence under the Environmental Planning and Assessment Act, 1979 to undertake building works without the required approvals, when an approval is required. Penalties for a breach of the Act include on the spot fines and may include prosecution. Council is committed to monitoring unauthorised or illegal building works. Council’s action against a breach of the Act is determined on a case by case basis.
A limited range of structures, such as small garden sheds and low retaining walls may be built without approval, however most building projects will need Development Consent and a Construction Certificate before commencing any work. Online forms are available here.
If you witness suspected illegal building works you can report it to Council by contacting Council's Development Monitoring Team on 9843 0555 or by lodging an online e- request for service.
