Development Control Plan


A Development Control Plan (DCP) is prepared and put into effect by Council. A DCP is prepared in accordance with the Environmental Planning and Assessment Act 1979, and is used by applicants and Council to guide the preparation and assessment of development applications.

In response to recent changes in legislation, Council has adopted The Hills Shire Development Control Plan (BHDCP) which applies to the entire Shire. The BHDCP is a comprehensive document that replaces all of Council's previously separate DCPs by consolidating them into the one principle DCP.

The BHDCP comprises two volumes and is divided into five parts with two Appendices. Parts C - E contain a number of individual sections of the DCP.

State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 (the Codes SEPP) specifies exempt development under that Policy. The Codes SEPP has state-wide application and commences on 27 February 2009. Consequently, from that date the exempt development provisions (for the development types covered by the Codes SEPP) in Baulkham Hills Local Environmental Plan 2005 will no longer apply.

Development build up environment

  • Part A - Introduction
    • Part A is the most important part of the BHDCP and must be read in conjunction with any individual section of the DCP. It contains information such as definitions, notification and advertising requirements, development application process, document specification and explanation of submission requirements.
  • Part B - Complying Development
    • Part B includes provisions for complying development relating to residential, business and employment development.
  • Part C - Land Use Zones
    • Part C contains sections of the DCP relating to particular land use zones including residential (villas, townhouses, apartments) rural, business, light industrial, open space and special uses.
  • Part D - General Development
    • Part D contains sections of the DCP relating to general types of development including parking, landscaping, child care centres and heritage.
  • Part E - Site Specific
    • Part E contains sections of the DCP relating to specific sites or areas including for instance Balmoral Road Release Area, Rouse Hill / Kellyville Release Area and Target Sites.

The BHDCP can be purchased from Council as a complete set ($200) or as separate sections ($10.50 or $20). Part A Introduction is included in the price of each section. All sections can also be downloaded and viewed on this site. Please note that some sections of the DCP include maps which can be viewed separately or purchased in full size from Council.
